Prohibitions
Section 820.301Â Prohibitions
A person must not:
a)
Beginning
one year after the effective date of
this Part,
own or operate a
GCDD
recovery facility without a permit issued by the Agency

b)
Cause
or allow the acceptance of any waste at a
GCDD
recovery facility, other
than
GCDD
.

c)
Cause
or allow the deposit or other placement of any
GCDD
that is received at
a
GCDD
recovery facility, including any
CCDD
fraction, into or on
any land or water. However, any
CCDD
fraction may be used as fill or
road construction material at a
CCDD
fill operation under Section 22.51
and
35 Ill. Adm. Code 1100
if the
CCDD
is separated and managed
separately from other
GCDD
and otherwise meets the requirements
applicable to
CCDD
at a
CCDD
fill operation.

d)
Cause
or allow the storage or treatment of
GCDD
at a GCDD recovery
facility
in violation of
the Act, this Part, any other rules or
standards adopted under the Act, or any condition of a permit issued under this
Act. [415 ILCS 5/22.38(m)]
e)Â Â Â Â Â Â Â Â Cause
or allow, at any one time, the accumulation of GCDD at the GCDD recovery
facility in an amount that exceeds the amount for which financial assurance must
be maintained under Subpart D.
f)Â Â Â Â Â Â Â Â Operate
a GCDD recovery facility:
1)
Without
the maintenance of documentation identifying the hauler, generator, place of
origin of the debris or soil, the weight or volume of the debris or soil, and
the location, owner, and operator of the facility where the debris or soil was
transferred, disposed
of
, recycled, or treated.

2)Â Â Â Â Â Â Â Â In a
manner that causes or allows:
A)Â Â Â Â Â Â Â Noise
outside the GCDD recovery facility that violates 35 Ill. Adm. Code 900 through
905 or Section 24 of the Act;
B)Â Â Â Â Â Â Â Vector
proliferation;
C)Â Â Â Â Â Â Â Litter
accumulation; or
D)Â Â Â Â Â Â Â Malodors
outside the GCDD recovery facility.
