Regarding the Indiana Industrial School for Girls and salaries of its board of trustees.
INDIANA INDUSTRIAL SCHOOL FOR GIRLS-SALARIES
OF NEW BOARD OF TRUSTEES.

Dear Madam-I am in receipt of your favor of the 24th inst.,
asking whether, under the act of 1905 (Acts 1905, p. 501), the new
board of trustees for the Indiana Industrial School for Girls are
authorized to receive salaries payable from the maintenance fund
provided for by said act, or whether they shall be paid from some
other fund.
The act of 1905 makes the following provision for the Indus-
trial School for Girls and Women's Prison: "Maintenance, $38,-
000."
The same act provides for a maintenance fund for the
use of the Industrial School for Girls, "when removed to a new
site."
It is evident that the latter appropriation is conditional upon
removal to the new location of the girls' school.
I am, there-
fore, of the opinion that no part of the latter appropriation can be
used at the present time to pay the salaries of trustees.
The act under which the boards of these two institutions are
at present organized, gives to each trustee a salary of $300 a
year and reasonable expenses not to exceed $125 per annum.
Section 5 of the act of 1907, concerning state institutions (found
on page 141 of the Acts of 1907), states that the compensation of
trustees "shall be paid quarterly as other expenses of the insti-
tutions are paid."
It seems evident that the maintenance fund of $38,000 pro-
vided by the act of 1905 was intended for the support of both in-
stitutions until their actual separation occurred; and thereafter
a special maintenance fund, created by the act of 1905, was avail-
able for the Industrial School for Girls.
The regular expenses of the latter institution would, in the
meantime, be payable out of the $38,000 maintenance fund;
accordingly, under the terms of the act of 1907 above quoted, the
salary and reasonable expenses of trustees are payable out of
the maintenance fund created for the joint use of both institutions.
