This regulation requires insurers to inform their licensed agents of the availability of Kansas assigned risk plans. That portion of the plan may be satisfied by having available to the agents an electronic version of the application forms. The Department is in the process of considering a modernized version of K.A.R. 40-3-30. However in the mean time, the Department expects each company to make a good faith effort to comply with the regulation when applicable. This regulation applies only to agents certified to write insurance for which a Kansas assigned risk plan is available. Agents should be informed of the assigned risk plans upon their initial appointment. All appointed agents should be informed of the assigned risk plans annually.
