Bulletin 2007-10 TO: All Insurance Companies Licensed to Transact Business In Kansas FROM: Sandy Praeger Commissioner of Insurance DATE: December 27, 2007 RE: Withdrawal of Bulletin 2001-5; Requirements of Trust Agreements and Letters of Credit referred to in K.S.A. 40-221a. Bulletin 2001-5 is withdrawn effective immediately. In pertinent part, Bulletin 2001-5 sets forth requirements regarding domestic insurers taking reserve credits on risks ceded to unauthorized insurers in the state of Kansas through the use of trust agreements or letters of credit by domestic insurers. On April 19, 2002, this Department adopted Kansas Administrative Regulation (“K.A.R.”) 40-1-43, which incorporated the requirements that were set forth in Bulletin 2001-5. Accordingly, Bulletin 2001-5 is duplicative of K.A.R. 40-1-47 and is no longer needed. Therefore, Bulletin 2001-5 is withdrawn effective immediately.
