Waiver

DHCD may waive the provisions of 760 CMR 38.00, in whole or in part, when in the judgment of DHCD strict compliance with such provision will be inconsistent with the public interest and with the purposes of M.G.L. c. 121B. No waiver shall be made if it conflicts with any mandatory provision of any statute. 760 CMR - 360.5
