Scope

940 CMR 40.00 regulations shall apply to Assisted Living Residences defined in M.G.L. c. 19D, §§ 1 and 2. 940 CMR 40.00 defines unfair or deceptive acts or practices that violate M.G.L. c. 93A, § 2(a). 940 CMR 40.00 regulations are not intended to define all activities that violate the statute. Acts or practices not specifically proscribed in 940 CMR 40.00 are not to be treated, by implication, as permitted under M.G.L. c. 93A or other applicable law.
