Filing Requirements for Gas Storage Companies Requesting the Authority to Acquire Property Through Eminent Domain Proceedings

PURPOSE: Applications to the commission for the authority to acquire property through eminent domain proceedings must meet the requirements of this rule. As noted in the rule, additional requirements pertaining to such applications are set forth in 4 CSR 240-2.060(1). (1) In addition to the requirements of 4 CSR 240-2.060(1), applications for gas storage companies for authority to acquire property through eminent domain proceedings shall include: (A) The legal description of the areas to be acquired; (B) A map showing the areas to be acquired; (C) Names and addresses of all persons who may have any legal or equitable title of record in the property to be acquired; and (D) The reasons it is necessary to acquire the property and why it is in the public interest. (2) If any of the items required under this rule are unavailable at the time the application is filed, they shall be furnished prior to the granting of the authority sought.
