The Governor of Mississippi did issue a Declaration of Emergency on January 22, 2026, which declared a state of emergency in Mississippi for a period beginning January 22, 2026, and ending on January 30, 2026. The Declared State of Emergency had the effect of automatically waiving the provisions of Title 19 Mississippi Administrative Code, Part 7, Chapter 9, Rule 9.04, and allowed liquefied petroleum gas dealers to fill tanks owned by other dealers during the existence of the declared state of emergency. Consequently, the prohibition against dealers filling the tanks of other dealers was not in effect from January 22, 2026, through January 30, 2026. Due to a continued lack of needed propane gas and delays in servicing the tanks of customers, the Mississippi Insurance Department (MID), which is the authority having jurisdiction over the regulation of liquefied compressed gas in the State of Mississippi, is issuing this Emergency Bulletin to address the imminent peril to public health, safety and welfare. Under this Emergency Bulletin the following procedural waiver is effective immediately: MID Regulation Title 19 Mississippi Administrative Code, Part 7, Chapter 9 (Handling of Liquefied Compressed Gas Containers), Rule 9.04 is hereby waived. Any propane customer in Mississippi may now temporarily request another propane dealer to fill their tank(s) and dealers are temporarily allowed to do so. This waiver is allowed in Rule 9.04 of MID Regulation 19 Mississippi Administrative Code, Part 7, Chapter 9, which specifically permits such actions "at the discretion of the authority having jurisdiction." All other legal and procedural requirements remain in place. Dealers are expected to observe all safety rules and regulations to ensure that no unsafe situation is allowed to exist.
