Public Records and Confidential Information

Public Records and Confidential Information. Records maintained by the Department in connection with the Certificate of Need Program shall be available in accordance with the Mississippi Public Records Act, Miss. Code Ann. § 25-61-1 et seq., and other applicable law. A person submitting information claimed to be confidential shall clearly identify the information and provide the legal basis for the claim. The Department shall determine whether information is subject to disclosure in accordance with applicable law. Nothing in this Manual requires disclosure of records or information made confidential or privileged by law.
