Notice of Intent. A Notice of Intent outlining the general scope of a planned project requiring a Certificate of Need shall be submitted to the Department as early as possible in the course of planning, but no later than fifteen (15) calendar days before any person files a CON application. A Notice of Intent shall be valid for six (6) months from the date of receipt. Page 17 — Mississippi State Department of Health Review of an application filed by a person who has not submitted a Notice of Intent at least fifteen (15) calendar days before the application shall be deferred until the fifteen (15) calendar day notice requirement is met. Under no circumstances shall a CON application be reviewed unless a Notice of Intent has been filed first. Submission of a Notice of Intent does not constitute approval of a project and creates no vested right in the applicant.
