Ex Parte Communications

Ex Parte Communications. After publication of a staff analysis and before a written decision by the State Health Officer, there shall be no ex parte contacts between: (a) any person acting on behalf of the Applicant, any CON-holder, or any person opposed to or in favor of the issuance or withdrawal of a Certificate of Need; and (b) the State Health Officer, the Chief of Staff, the hearing officer, or Department staff responsible for administration of the CON Program. This prohibition does not apply to communications between and among Department staff members, the hearing officer, the Director, the Chief of Staff, the State Health Officer, and the staff of the Mississippi Attorney General’s Office. Violations may be subject to penalties authorized by applicable law.
