Certificate of Need Validity — Scope, Location, and Person. Pursuant to Miss. Code Ann. § 41-7-195(1), a Certificate of Need is valid only for the defined scope, physical location, and person named in the application. A CON is not transferable or assignable, nor shall a project or capital expenditure project be transferred from one person to another, except with the approval of the Department. A CON-holder may not operate outside the approved scope, outside the approved physical location, or under the authority of a CON held by a different person, without prior Department approval. Any material change in the approved scope, physical location, or ownership of a CON shall be reported to the Department in accordance with this chapter and may require a new CON or Department approval of a modification.
