OPINION 45-264 May 21, 1945 (OPINION) STORAGE LOCKERS RE: No Law Governing Charges Re: 5F:6:L:MSA. I received your letter of May 18, in which you state that a question has arisen as to what charges a cold storage locker plant operator may charge for locker rentals under appropriate maximum price regulations and particularly as to what additions he may make over his base period prices. You also state that part of your question is dependent upon whether or not the locker plant operator must furnish insurance under section 60-0704 of the North Dakota Revised Code of 1943. Chapter 60-07 of the North Dakota Revised Code of 1943 deals with storage companies. I have ascertained from the public service commission that it has taken no jurisdiction of cold storage locker plants. There appears to be no law on our statutes concerning the regulation of cold storage locker plants. It appears to me that chapter 60-07 does not have any application to cold storage locker plants and, accordingly, section 60-0704 is not applicable to them. It is the opinion of this office that chapter 60-07 does not have any application to cold storage locker plants and that they do not come within its terms and are not subject to the regulations therein set forth.
