OPINION 46-219 June 26, 1946 (OPINION) OFFICES RE: Must be Qualified for - When Term Commences This is in reply to your letter of June 24, 1946, addressed to the attorney general. You inquire whether the fact that an individual who has been within the precinct for thirty days prior to the primary election, but not within the county for ninety days, but is a resident of the state for over one year and who secures sufficient and required number of votes at the primary election by stickers, prevents him from having his name printed on the ballot for the fall election. If this party is elected at the November election, he may qualify for the office if he has the necessary qualifications at the time when he is required to qualify for same. Answering your specific question as to whether this person may have his name printed on the November ballot, it is our opinion that he has that right. NELS G. JOHNSON Attorney General
