OPINION 46-224 April 11, 1946 (OPINION) PLUMBING RE: Meetings of Board This office is in receipt of your letter of April 10, 1946, in which you request our opinion as to whether or not the state plumbing board may hold special meetings and conduct special examinations in cities other than Bismarck, the state capitol. Section 43-1812 of the 1943 Revised Code requires the board: "To hold two public meetings each year at the state capitol for the purpose of examining persons who may desire to take the examination and become registered and licensed plumbers---." Such regular meetings and examinations are mandatory--not discretionary--with the board. It was clearly the intention of the legislature that examinations should be held at least twice each year. For it is conceivable, although not probable, that if the matter of holding examinations were discretionary with the board, the opportunity to take the examination might be delayed or even denied. It is our opinion that if the state plumbing board deems it advisable, it may conduct special examinations at places other than the state capitol. NELS G. JOHNSON Attorney General
