MOTOR VEHICLE
RE: Definition of
Re: Section 57-4201 of the North Dakota Revised Code of 1943
Your letter of August 20 referring to Chapter 262, Section 1 of the
1943 Session Laws has been received and referred to my desk.
This chapter is now Section 57-4201 of the North Dakota Revised Code
of 1943. It is my opinion that the term "motor vehicle" found in the
third line of subdivision 2 of the above section means and includes
any and all vehicles of every kind or nature which are actually
propelled by internal combustion engines. It is, therefore,
naturally concluded that rubber tired motor grader patrols actually
propelled by internal combustion engines and not hauled by a vehicle
so propelled are motor vehicles and caterpillar track type tractors
are also motor vehicles.
