OPINION 49-161 December 19, 1949 (OPINION) POULTRY IMPROVEMENT BOARD RE: Attachment of Gummed Stamps I acknowledge receipt of your letter of December 14, 1949, wherein you request an opinion on the legality, under the statute creating the Poultry Improvement Board and collection of fees by said Board on all feed sold in the state of North Dakota, to have attached to the back of the ingredient tag, which is required by law, a gummed stamp so as to facilitate the collection of fees now allegedly being lost to the Board. It is the opinion of this office that the attachment of such a gummed stamp to facilitate the collection of the fees as prescribed by statute is entirely legal and lawful. We believe that the Board is empowered by legislative implication to create reasonable means for the collection of the statutory fees, and we believe that the attachment of such a gummed stamp as you propose is not an unreasonable method, and that you are authorized by law to do the same.
