TO: All Property & Casualty Companies Writing Political Subdivision Coverage in the State of North Dakota
RE: Chapter 32-12.1 - Political Subdivision Coverage
Section 32-12.1-06 N.D.C.C. states in part:
"The insurer under any policy of insurance purchased pursuant to this chapter shall certify to the Commissioner that the policy is sufficient to provide coverage to the limitations established by this chapter. The statement of certification shall be on a form prescribed by the Commissioner..."
A form is enclosed to be completed for each policy issued or renewed in the years 1981, 1982, 1983 and 1984, in which coverage is afforded to a political subdivision of North Dakota. A political subdivision:
a. Shall include all counties, townships, park districts, school districts, cities, and any other units of local government which are created either by statute or by the Constitution of North Dakota for local government or other public purposes, except no new units of government or political subdivisions are created or authorized by this chapter.
b. Shall not include nor be construed to mean either the State of North Dakota or any of the several agencies, boards, bureaus, commissions, councils, courts, departments, institutions, or offices of government, which collectively constitute the government of the State of North Dakota.
These forms should be filed on or before the date set for the filing of your Annual Statement, March 1, 1985.
Specifications were established by former Commissioner, Byron Knutson in 1978. Consideration is being given to updating those specifications, but such an update will not occur prior to the filing date for your Certification of Compliance.
