Pomeroy, Commissioner of Insurance DATE: July 29, 1987 SUBJECT: Mandated Underinsured Motor Vehicle Insurance Coverage House Bill No. 1279, approved by the 1987 Legislative Assembly, requires all motor vehicle liability insurance policies to include underinsured motor vehicle insurance coverage after July 1, 1987. This new legislation has raised many questions from companies, agents, and insureds alike. The following is a summary of the requirements relative to the new underinsured motorist coverages: 1. Underinsured motorist coverage is now mandatory. 2. The minimum insurance coverage requirements for bodily injury, property damage, and uninsured motorists were not changed. 3. The minimum underinsured motorist coverage is now $50,000 per person and $100,000 per accident or a combined single limit of $100,000 per accident, or the insured's bodily injury liability limits, whichever is greater. 4. The appropriate effective date for placement of the newly mandated underinsured motorist coverage to an existing insurance policy is at the time of renewal. However, any new motor vehicle liability insurance policies issued on or after July 1, 1987, must include the mandated coverage.
