Determination of ground water restoration demonstration

In deciding whether a sufficient demonstration has been made by the operator under subsection 1
of section 43-02-02.2-18, the department shall consider the premining baseline water quality and
geochemistry, including up-gradient and down-gradient aquifers and the direction and velocity of
ground water movement through the producing zone.
