Amendments to the Plan ofOperation !RSA 420-KI
WHEREAS, pursuant to the provisions of2005 Chapter 225, RSA 420-K:2 I., a non-profit entity
known as the "New Hampshire smaJI employer health reinsurance pool" (NHSEHRP) was established; and
WHEREAS, the Commissioner approved a Plan ofOperation (Plan) for the NHSEHRP on
October 25, 2005 pursuant to the provisions of RSA 420-K:2 IV.; and
WHEREAS, the Board of the NHSEHRP has placed before the Commissioner amendments to the
Plan with a revised health form dated October 7, 2007; and
WHEREAS, pursuant to RSA 420-K:2 IV., the commissioner shall provide notice and hearing
prior to detennining whether amendments to the Plan with the revised health form should be approved;
now, therefore, be it
ORDERED, that:
I. Pursuant to the provisions ofRSA 400-A: 17, a public hearing on the Board's proposed
amendments to the Plan with revised health form for the NHSEHRP will be held at the offices ofthe New
Hampshire Insurance Department, 21 South Fruit Street, Suite 14, Concord, New Hampshire on October
24, 2007 at 2:00 p.m.
2. The above referenced amendments to the Plan with revised health form shall be made available
to all carriers and interested parries on the New Hampshire Insurance Department website:
www.nh.gov/insurance/News/Bulletins/bulletin-index.hun.
3. The purpose ofthe hearing, pursuant to RSA 420-K:2 IV, is for the commissioner to hear
testimony from interested parties as to whether the amendments to the Plan with revised health form
continues to provide for fair, reasonable and equitable administration ofthe pool and as to whether the Plan
with amendments continues to provide for the sharing ofpool gains or losses on an equitable proportionate
basis.
4. Interested parties who provide written testimony on or before October 22, 2007, will be given
speaking priority. Depending on the number of interested parties wishing to testify, the hearing officer may
limit oral testimony. Therefore, all interestt:d parties are encouraged to provide written testimony. The
record will be kept open through October 26, 2007. Written testimony will be accepted through that day.
6. The public hearing shall be conducted pursuant to the applicable provisions of RSA 400-A,
specifically RSA 400-A: 19, and Ins 200.
7. The public hearing will be recorded. However, ifparticipants desire a transcript of the public
hearing, they must provide for the services ofa shorthand reporter.
