OAR 860-036-1840. Transfer of Approved Service Territory

(1) The rights acquired by an approved service territory may be transferred only with the approval of the Commission. The application must include: (a) The application requirements as provided in OAR 860-036-1810; (b) Evidence demonstrating that the transfer of the service territory is in the public interest. (2) Within 15 calendar days of the filing date of the application, a water utility must provide written notice to each customer affected by the application that contains the information required by OAR 860-036-1810(2) as modified to reflect the request to transfer designated service territory. (3) Designated service territory will not be altered solely as the result of a change in ownership or form of ownership.
