ESTADO LIBRE ASOCIADO DE PUERTO RICO # OFICINA DEL COMISIONADO DE SEGUROS 4 de mayo de 1982 Carta Circular E-4-876-82 A TODOS LOS ASEGURADORES DEL PAIS Asunto: Regla XIV-A; Informe Sobre Evaluación del Sistema de Control Interno para el año 1981 y años subsiguientes Señores: El sistema de vigilancia de las operaciones y la solvencia económica de los aseguradores autorizados en el país ha sido, indudablemente, fortalecido por la aprobación de la Regla XIV-A del Reglamento del Código de Seguros de Puerto Rico. No obstante, la interpretación del Artículo IX de la mencionada regla (Informe Sobre Evaluación del Sistema de Control Interno) ha sido motivo de confusión para diversos aseguradores del país, y los contadores públicos autorizados que los representan. La Oficina del Comisionado de Seguros, atendiendo y respondiendo a planteamientos provenientes tanto de la industria de seguros como de los contadores públicos autorizados que la representan, ofrece, por la presente, las siguientes alternativas, las cuales entendemos que son medios viables y económicos que cumplen con el objetivo perseguido por la Regla XIV-A. Sin pretender que de manera alguna se menoscabe el espíritu y objetivo comprendidos dentro del mencionado Artículo IX de la referida Regla XIV-A, y las anteriores cartas circulares emitidas a tales efectos, los modelos de opinión de Informes Sobre Evaluación del Sistema de Control Interno que a continuación se describen, serán aceptables para esta Oficina: 1. El modelo de opinión que aparece en la página 13, párrafo 39 del Pronunciamiento Sobre Normas de Auditoría, #30, emitido el 6 de julio de 1980 por el Instituto Americano de Contadores Públicos Autorizados. 2. El modelo de opinión que se incluye con esta carta circular. Apartado 3508—Estación Viejo San Juan—San Juan, Puerto Rico 00904 -2- En cualquier caso, sea cual fuere el modelo utilizado de aquellos señalados como aceptables a esta Oficina, el mismo deberá acompañarse de una copia fiel y exacta de la Carta a la Gerencia para la misma fecha. Esta carta circular será aplicable comenzando con aquellos informes relacionados al año 1981 y años subsiguientes. Cordialmente Juan Antonio García Comisionado de Seguros Anejo To the Board of Directors of XYZ Company: We have examined the financial statements of XYZ Company for the year ended December 31, 19XX, and have issued our report thereon dated February 23, 19XX. As part of our examination, we made a study and evaluation of the Company's system of internal accounting control to the extent we considered necessary to evaluate the system as required by generally accepted auditing standards. The purpose of our study and evaluation was to determine the nature, timing, and extent of the auditing procedures necessary for expressing an opinion on the Company's financial statements. The management of XYZ Company is responsible for establishing and maintaining a system of internal accounting control. In fulfilling this responsibility, estimates and judgments by management are required to assess the expected benefits and related costs of control procedures. The objectives of a system are to provide management with reasonable, but not absolute, assurance that assets are safeguarded against loss from unauthorized use or disposition, and that transactions are executed in accordance with management's authorization and recorded properly to permit the preparation of financial statements in accordance with generally accepted accounting principles and/or statutory accounting principles as prescribed or permitted by the Commissioner of Insurance of Puerto Rico. -2- Because of inherent limitations in any system of internal accounting control, errors or irregularities may nevertheless occur and not be detected. Also, projection of any evaluation of the system to future periods is subject to the risk that procedures may become inadequate because of changes in conditions or that the degree of compliance with the procedures may deteriorate. In our opinion, the system of internal accounting control of XYZ Company in effect at December 31, 19XX, based on our study and evaluation of such system as indicated in the first paragraph above, was sufficient to meet the objectives stated in the second and third paragraphs above insofar as those objectives pertain to the prevention or detection of errors or irregularities in amounts that would be material in relation to the Company's financial statements (except as indicated below). This report is intended solely for the use of management and for filing with the Commissioner of Insurance in Puerto Rico in compliance with Section nine of Rule XIV-A of the Puerto Rico Insurance Code, and should not be used for any other purpose.
