Notice of Corrections to Resolution
Of September 30, 1979
I, Carlos S. Quirós, Puerto Rico Secretary of Labor and
Human Resources, pursuant to the authority conferred by Section 8
of the Puerto Rico Occupational Safety and Health Act, Act Number
16 of August 5, 1975 (29 LPRA 361 et seq.) as amended, adopted the
"Occupational Exposure to Lead" final standard as published in the
Federal Register, Volume 43, Number 2200 of November 14, 1978,
with Corrections published in Federal Register, Volume 44, Number
168 of August 28, 1979.
This adoption was to be effective immediately after its approval with some exceptions. Through inadvertence, and some typographical mistakes the scope of the exempted provisions was
changed.
Therefore, I hereby amend the above mentioned Resolution to
read as follows:
This adoption shall be effective immediately after its approval with the following exceptions:
1) Paragraph 1910.1025 (e) (1) - Methods of Compliance/
Engineering and Work Practice Controls.
2) Paragraph 1910.1025 (e) (3) - Compliance Program (Except
that (e) (3) (ii) (F), relating to compliance plans for protective
clothing, hygiene and housekeeping practices is effective immediately).
3) Paragraph 1910.1025 (e) (4) - Bypass of Interim Level.
4) Paragraph 1910.1025 (e) (5) - Mechanical Ventilation.
5) Paragraph 1910.1025 (e) (6) - Administrative Controls.

6) Paragraph 1910.1025 (f) - Respiratory Protection -
paragraph (f) (2) (ii), relating to employee selection of powered,
air purifying respirators (PAPR), is modified so that PAPR's must
be provided under that paragraph only when the physical characteristics of the employee are such that the respirators specified in
Table II (paragraph (f) (2) (1) are inadecuate for the employee's
protection. (Note that dust, fume and mist air purifying respirators are permitted to be used in addition to the respirators listed
in Table II under the terms of the temporary administrative stay
as published at 44 FR 5446)
The rest of the paragraph is in effect.
7) Paragraph 1910.1025 (i) - Hygiene facilities and practices
to the extent that it requires the construction of new facilities
or substantial renovation of existing facilities. The rest of the
paragraph is in effect.
8) Paragraph 1910.1025 (j) - Medical Surveillance is in
effect (except on the requirements for ZPP determinations in paragraphs (j) (2) and (j) (3) (ii) (D) (3), and except for the requirements
for the multiple physician review mechanism established in paragraph (j) (3) (iii) and referred to elsewhere in the standard).
9) Paragraph 1910.1025 (m) - Signs.
In addition, the standard for lead in 4 OSH 1910.1000 will
remain in effect during the period of the stay and will continue
to be enforced by OSHO. Section 1910.1000. Table Z-2, sets a
permissible exposure limit of 0.2 milligrams of lead per cubic
meter of air as an 8-hour, time weighted average, which must be
complied with by the use of feasible engineering or administrative
controls (1910.1000 (e)
The stayed paragraphs will be effective thirty (30) days
after public notice is given in two newspapers advising of their
effectiveness.
