PARTICULATE EMISSIONS FROM INDUSTRIAL PROCESSES
3.1 Definitions
Unless otherwise expressly defined in this section, the terms used in this regulation shall be
defined by reference to the Rhode Island Air Pollution Control General Definitions
Regulation. As used in this regulation, the following terms shall, where the context permits,
be construed as follows:
3.1.1 "Process weight" means the total weight of all materials introduced into any
specific process, except liquid and gaseous fuels and combustion air, which may
cause any emissions of particulate matter into the atmosphere.
3.2 Limitations
No person shall emit into the atmosphere in any one hour from any source, except those specific
types of sources to which emission standards elsewhere in these rules and regulations apply,
particulate matter in excess of that shown in the following table opposite the applicable process
weight. In entering the table "the process weight rate" will be determined by dividing the total
process weight by the number of hours in one complete operation, excluding anytime during
which the equipment is not operating.
3.3 Determination of Compliance
Compliance with Section 3.2 shall be determined by one of the following procedures:
(a) Emission testing conducted by the owner or operator of the source according to Method 5 of
Appendix A to Part 60 of Title 40 of the Code of Federal Regulations, or by another method
which has the prior approval of or is required by the Director.
(b) Technical evaluation based on such factors which may include the potential of the industrial
process for emitting particulates; design of the process, equipment or facility; design
efficiency of air pollution control systems; and emission test results on similar processes,
equipment or facilities.

3.4
General Provisions
3.4.1
Purpose
The purpose of this regulation is to limit particulate emissions from
industrial sources.
3.4.2
Authority
These regulations are authorized pursuant to R.I. Gen. Laws § 42-17.1-
2(s) and 23-23, as amended, and have been promulgated pursuant to the
procedures set forth in the R.I. Administrative Procedures Act, R.I. Gen.
Laws Chapter 42-35
3.4.3
Application
The terms and provisions of this regulation shall be liberally construed to
permit the Department to effectuate the purposes of state law, goals and
policies.
3.4.4
Severability
If any provision of this regulation or the application thereof to any person
or circumstance, is held invalid by a court of competent jurisdiction, the
validity of the remainder of the regulation shall not be affected thereby.
3.4.5
Effective Date
The foregoing regulation, "Particulate Emissions from Industrial
Processes”, as amended, after due notice, is hereby adopted and filed with
the Secretary of State this _________ day of _______________, 20___ to
become effective twenty (20) days thereafter, in accordance with the
provisions of Chapters 23-23, 42-35, 42-17.1, 42-17.6, of the General
Laws of Rhode Island of 1956, as amended.

Interpolation of the data in this table for the process weight rates up to 60,000 Lb/Hr shall be
accomplished by use of the equation: E = 4.10 P0.67, and interpolation and extrapolation of
the data for process weight rates in excess of 60,000 Lb/Hr shall be accomplished by the
equation: E = 55.0 P0.11 - 40, where E = rate of emission in Lb/Hr and P = process weight
rate in Tons/Hr.
