MAINDA GOVERNOR COMMISSIONER TO: All Companies Licensed or Authorized to Write Property and Casualty Insurance in Tennessee FROM: Hodgen Mainda, Commissioner RE: Notice of Catastrophe Claims Data Call related to the April 12th and 13th Tornadoes DATE: April 21, 2020 This correspondence is being issued to provide notification and guidance on reporting requirements relating to the impact of the recent tornadoes that occurred April 12th and 13th, 2020 in Tennessee. In accordance with Tenn. Code Ann. §§ 56-1-409(b), 56-8-107(a), and 56-14-109(c) the Department is requiring all authorized property and casualty insurance companies, including licensed insurers and eligible surplus lines insurers, to complete the attached claims reporting spreadsheet and return it to the Department. The table below outlines the initial scheduled deadlines for data call submissions. Following the below deadlines, submissions will be due on a monthly basis every first Friday of the month for data reported as of the first Wednesday of the month. Only claims relating to the tornadoes that occurred April 12th and 13th, 2020 should be reported; non-catastrophe claims should be excluded. The first report is due, May 1, 2020 for claims reported as of Wednesday, April 29, 2020. Data Call for Tennessee tornadoes that occurred April 12th and 13th, 2020 Data Call Report Number Cumulative Catastrophe Claims Data Reported As Of Due Date 1st Report 4/29/2020 5/1/2020 2nd Report 5/13/2020 5/15/2020 3rd Report 6/3/2020 6/5/2020 4th Report 7/8/2020 7/10/2020 ***Excel files of completed reports should be submitted via email to David Combs, Director of External Affairs, at David.Combs@tn.gov by the due dates indicated above (and also reflected in the excel spreadsheet's instructions tab).*** In the subject line, please refer to the actual report number (i.e., 1st report, 2nd report, etc. in accordance with due dates specified). Please refer to the instructions tab for additional guidance relating to this data call. Any additional questions may be submitted to David.Combs@tn.gov. This notice does not apply to life or health insurers, monoline financial guaranty, mortgage guaranty, title, fidelity and surety, workers' compensation, medical malpractice insurers, professional liability insurers, or reinsurers. If a company has multiple insurers within a holding company group, it will not be necessary to complete an excel spreadsheet for each insurer. Instead, the holding company group should aggregate the information into one excel spreadsheet and provide (on the instructions tab) a list of those insurers within the group for which information is being aggregated. However, surplus line insurance companies should submit information on an individual company basis. If there is a surplus lines insurer within a group, the group should exclude the surplus lines insurer from the aggregated report as surplus lines insurers will be required to report their data separately from the group. The data required under this data call must be submitted in excel format. In accordance with Tenn. Code Ann. §§ 56-1-411(f) and 56-8-107(d)(l), company responses must and will be treated as strictly confidential. Responses may be aggregated for purposes of public disclosure. Please note that the Department is requesting data at the zip code level. Respondents should include a breakdown of claims data by zip code and provide the name of the corresponding city or town for each zip code provided. The instructions tab includes details on how to report claims for which the zip code and/or city/town is unavailable. A copy of the data call excel spreadsheet template can be downloaded from the Department's website at https://www.tn.gov/commerce/insurance/company-resources.html. The Department reserves the right to request additional information or broaden the scope of the data call in response to any developments or information received.
