(1) Utilizing the aid of bait while hunting white-tailed deer is only allowed on privately owned or leased lands and only if the person has purchased a Deer Bait Privilege License. (2) A Deer Bait Privilege License is an annual license and must be obtained in the same manner as a hunting license, as provided in Rule 1660-01-28-.15. (3) A person who is exempt from purchasing a hunting license is not exempt from the requirement to purchase a Deer Bait Privilege License (T.C.A. § 70-4-113). This includes sportsman license holders. (4) A person hunting over bona fide normal agricultural practices or wildlife food plots established and maintained as part of ordinary agricultural or habitat management practices is not required to obtain a Deer Bait Privilege License. (5) Each individual hunter in a hunting group or party who hunt over bait are required to purchase and have in their possession a Deer Bait Privilege License. (6) The Agency may, without refund, suspend the use of a deer baiting privilege and/or adopt additional rules to manage the feeding of wildlife on a county, regional, or statewide basis to prevent the spread of diseases among wildlife by announcing the suspension in a news release.
