Procedures For Foster Child Bill Of Rights

(1)
For a foster child over the age of thirteen (13), the DCS case manager shall review the Foster
Child Bill of Rights with the child in person and provide the child a copy of the Foster Child Bill
of Rights within thirty (30) days of the date that the child entered foster care.
(2)
For a foster child under the age of thirteen (13) or whose capacity to understand his/her rights
may be limited, the DCS case manager shall meet with the foster child and the foster child’s
foster parent(s); review the Foster Child Bill of Rights with the foster child and the foster
parent(s); and provide the foster child and the foster parent(s) a copy of the Foster Child Bill of
Rights on the foster child’s behalf.

The foster child’s DCS case manager shall also review the Foster Child Bill of Rights with a
foster child as part of the foster child’s annual permanency hearing and provide the foster child
with a current copy of the Foster Child Bill of Rights. In the event the foster child is unable to
personally appear for his/her annual permanency hearing, the DCS case manager shall make
reasonable efforts to meet with the foster child and provide the Foster Child Bill of Rights to
the foster child prior to the permanency hearing.
