(1) “Registrant” means the owner or lessee of a motor vehicle subject to title and registration requirements under T.C.A. § 55-3-101(a). (2) “User fee” shall have the same meaning as provided in T.C.A. § 54-3-103(20) and shall refer to fees established and implemented pursuant to T.C.A. § 54-3-107. (3) “User fee facility” shall have the same meaning as provided in T.C.A. § 54-3-103(21). (4) “Nonpayment event” means a single instance in which a registrant drives through a user fee facility without the payment of the user fee, where the fee remains unpaid or partially unpaid 30 days or more following the postmark date of an invoice or notice issued pursuant to T.C.A. § 54-3-114(d). (5) “Habitual violator” means a registrant that drives through a user fee facility without payment of the user fee three or more times within a 12-month period, consistent with T.C.A. § 54-3- 114(j)(1), provided the following conditions are met: (a) The registrant’s failures to remit user fees when due remain uncured for a period of 30 days or more such that the unpaid fees constitute a nonpayment event; (b) The nonpayment events attributable to the registrant occurred on at least three separate calendar days; and (c) The total amount of unpaid user fees owed by the registrant is greater than or equal to $100, excluding administrative fees. (6) Vehicle Title and Registration System (“VTRS”) means the system maintained by the Department of Revenue as the system of record for state motor vehicle titles and registrations pursuant to Tennessee Code Annotated, Title 55.
