BULLETIN 2024-10 4315 South 2700 West, Suite 2300, Taylorsville, Utah 84129 ● Office (801) 957-9200 ● Facsimile (385) 465-6047 ● insurance.utah.gov State of Utah SPENCER J. COX Governor DEIDRE M. HENDERSON Lieutenant Governor Insurance Department JONATHAN T. PIKE Insurance Commissioner To: All Title Insurance Licensees From: Jonathan T. Pike, Insurance Commissioner Date: August 26, 2024 Subject: Title Licensees' Questions Regarding Rule R592-6 The Utah Insurance Department (Department) regularly receives questions from title licensees about the meaning and application of Utah Admin. Code R592-6, Unfair Inducements and Marketing Practices in Obtaining Title Insurance Business. Because the Title and Escrow Commission’s (TEC) role includes “advis[ing] the commissioner of the most critical matters affecting the title insurance industry,” those questions will be answered in the future by the TEC. See Utah Code § 31A-2-404(2)(f). A question must be submitted by email to title@utah.gov. The Department will redact personal identifiers from the email and forward the question to the TEC for discussion and response at its next monthly meeting. Questioners are encouraged to attend the meeting either in person or virtually to participate in the discussion. After the meeting, the TEC will draft a response to the question and forward it to title@utah.gov. The Department will then send the response to the questioner. A record of questions and responses will be maintained on the Department’s website at https://insurance.utah.gov/licensees/title/tec/. The TEC’s responses are advisory. They are not legal advice and are not binding on the TEC, the Department or the insurance commissioner. DATED this 26th day of August 2024. _________________________________ Jonathan T.
