R993-100-109. Rescheduling or Continuance of Hearing

(1) The ALJ may adjourn, reschedule, continue, or reopen a hearing on the ALJ's own motion or upon motion of the applicant or client or the Department. (2) If a party knows in advance that they will be unable to proceed with or participate in the scheduled hearing, the party must request that the hearing be rescheduled or continued. (a) The request must be submitted before the hearing. (b) The request must be made orally or in writing to the ALJ who is assigned to hear the case. If the request is not submitted before the hearing, the requesting party must show cause for failing to make a timely request. (c) The requesting party must show cause for the request. (d) Normally, a party will not be granted more than one continuance. (3) The rescheduled hearing must be held within 30 days of the original hearing date.
