R993-100-110. Default Order or Dismissal for Failure to Participate

(1) If a hearing has been scheduled at the request of an applicant or client and they fail to appear at or participate in the hearing, either in-person or through a representative, the ALJ will, unless a continuance or rescheduling has been requested, dismiss the request for a hearing. (2) A default order will be based on the record and best evidence available.
