(a) When there is no immediate jeopardy, but a facility is not in substantial compliance, the Department shall take action pursuant to 42 C.F.R. § 488.412, as supplemented by the SOM, both of which are incorporated by this reference. (b) The Department shall follow the procedures specified in 42 C.F.R. § 488.412, as supple- mented by the SOM.
