AFFIDAVIT OF THE ATTESTING WITNESS OF THE WILL
Affidavit of Sh. First deponent's name, aged about First deponent's age years, S/o First deponent's father's name, R/o First deponent's address, who do hereby solemnly affirm and declare as under:-
1.That I, the Deponent, am fully conversant with the facts and circumstances of the case and am therefore competent to swear this Affidavit.
2.That I am one of the attesting witnesses to the Will dated Date of Will executed by Name of deceased testatrix, W/o Deceased's husband's name, who died on Date of death of testatrix.
3.That the Will dated Date of Will was executed by Name of deceased testatrix of her own free will and choice, without any force, pressure, threat or inducement from any quarter. The said Will was executed by Name of deceased testatrix in the presence of the Deponent and the other attesting witness, namely Second attesting witness's name, W/o Second witness's husband's name, R/o Second witness's address. A copy of the Will dated Date of Will is Ex.PW2/1, and a copy of the Aadhaar Card is Ex.PW2/2.
4.That the other attesting witness, Second attesting witness's name, W/o Second witness's husband's name, R/o Second witness's address, also signed the said Will dated Date of Will in my presence.
5.That the said Will dated Date of Will was signed in my presence, and at the time of its execution the executant was of sound and disposing mind, acting without any influence from any quarter.
6.That by her last Will dated Date of Will, Name of deceased testatrix bequeathed her share, i.e. 50%, in the immovable property bearing Property number, Delhi, in favour of the Petitioner, to the exclusion of the other legal heirs.
7.That the contents of the foregoing paragraphs are true and correct to the best of my knowledge and belief.
