HAR §11-37-42. Application

(a) To apply for a permit, an applicant shall submit the following information to the department on a form and in a manner prescribed by the department: (1) The applicant's name, mailing address, and phone number in Hawaii; (2) Proof of no disqualifying felony convictions, which shall be established by an individual applicant or, if the applicant is a firm, corporation, partnership, association, or any form of business or legal entity, an individual acting on behalf of the entity by providing either: (A) A copy of the applicant's license to produce hemp, issued by the USDA pursuant to title 7 United States Code section 1639q; (B) Consent to a background check that includes but is not limited to fingerprinting and criminal history checks pursuant to section 846-2.7, HRS, and documentation of the authority of the individual to act on behalf of the applying entity; (C) Criminal history record information; or (D) An FBI identity information summary sheet. (3) The physical address and tax map key (TMK) number of the land on which the hemp processor is to operate; (4) A description of the enclosed indoor facility where the hemp processor will operate, demonstrating how the hemp processing facility meets the applicable facility requirements of subchapters 6 and 7; 37-47 3622_ §11-37-42 (5) Attestation that the hemp processing facility complies with section 11-37-51(a), if applicable; (6) Documentation and attestation that: (A) The hemp processor's indoor facility and planned hemp processing operation complies with all zoning ordinances, building codes, and fire codes; or (B) The planned processing will not include heat, volatile compounds, or gases under pressure and will take place in an enclosed indoor facility that is: (i) Exempt from building permit and building code requirements pursuant to section 46-88, HRS; or (ii) In a food hub or agricultural park; (7) Distribution location; (8) Retail location; (9) Website; (10) Required attestations for distribution and retail registration, in accordance with section 11-37-11(b)(13); and (11) Any other information requested by the department. (b) Every application shall be signed by a person with authority to represent the applicant and shall constitute an acknowledgment and agreement that the applicant will comply with this chapter. (c) In addition to the application form, each applicant shall submit a non-refundable application fee in accordance with section 11-37-44. If the fee does not accompany the application, the application shall be deemed incomplete. (d) The department may require the submission of additional information after the application has been submitted and may suspend the processing of the application until such time as the applicant has supplied all required information or otherwise corrected the deficiency.
