HAR §15-34-3. Purpose of program

The purpose of the altemati ,·e energy
research and de, elopment program is to pro,·ide grams to businesses that are
developing clean energy solutions in Hawaii with a high technology readiness
level or high potential for implementation as e\ idenced by an award of a
competiti\·e contract from the United States Department of Defense Office of

§15-34--1 Grants~ purpose; use of. (a) The deye[opment corporation
may pro\ide grants in accordance with Act 67, Session Laws of Hawaii 2018.
(b)
Grants may be used by any recipient to purchase equipment or
ser,ices, augment staff to add e:-i.pertise required to expedite or enhance the
quality of the program \Vork. or prepare for subsequent program actiYities leading
to commercialization of the technology.
(c)
Grants shall not be used by any recipient for any of the
following purposes:
(I)
\\'here the direct or indirect purpose or result of the grant \vould be
to:
(A)
Repay a creditor or creditors of the recipient for any
reason: or
(B)
Pro,ide funds directly or indirectly as a loan to owners.
partners. or shareholders of the recipient:
(2)
Effect a change in ownership of the recipient:
(3)
Provide or free up fonds for acquisition of any kind of real
property:

§15-3..i-5 Eligibility requirements. Any business applying for a grant
shall meet all of the following qualifications:
(I)
Has been awarded a competiti\·e contract from the United States
Department of Defense Office ofNa\·al Research related to the
research of altematiYe energy and energy efficiency technologies
in the fields ofgeothermal, solar, wind, ocean power.
hydrodynamics, bioenergy, biomass. solid \Vaste. smart grids.
transportation, or demand response:

fs sixty per cent or more resident-owned. For purposes ofthis
section, "resident" shall ha\·e the same meaning as defined in
section 235-1, HRS:

Is a for-profit entity organized under the laws of the State:
(-l)
Has been doing business in the State for a minimum ofone year;
(5)
Agrees to expend all grant funds a,varded under the alternatiYe
energy research and deYelopment program in the State;
(6)
Conducts research in alternati,e energy that has a high technology
readiness le, el or high potential for implementation as evidenced
by a contract. funded by moneys designated by the United States
Congress as funding for alternatiw energy and a national defense
budget funding directiw. with the United States Department of
Defense Office of >la,·al Research that is acti\ e or was a,,·arcled
after July I. 20 I 5;
(7)
Has not obtained any other State grant for the same research at the
time of or during the duration of the alternati, e energy research
and de\'elopment program grant:

Has byla,\'s or policies that describe the manner in which the
acti, ities or sen ices for which the grant is awarded shall be
conducted or pro\·icled:
(9)
ls licensed or accredited, in accordance with federal, state. or
county statutes, rules, or ordinances, to conduct the acti\'ities or
proYide the sen·ices for \Yhich the grant is a,varcled:
(10)
Complies with all applicable federal and state laws prohibiting
discrimination against any person on the basis of race. color.
national origin, religion. creed. sex, age. sexual orientation. or
disability; and
(11)
Allows the dewlopment corporation. legislati\'e committees and
their staff. and the auditor full access to its records. reports. files.
and other related documents and infonnation for purposes of
monitoring, measuring the effecti, eness, and ensuring the proper

§15-3~-6 Application procedure. Any business applying for a grant
shall pro\·ide as part of the application a copy of a contract awarded to the
applicant by the United States Department of Defense Office of NaYal Research
relating to the research of alternative energy and energy efficiency technologies in

the fields of geothermal, solar, wind. ocean po\\'er. hydrodynamics. bioenergy.
biomass. solid \\·aste. smart grids, transportation, or demand response. The
contract. or accompanying documentation. shal l show that it is existing and acti, e
or was a\\·arcled after July I, 2015, and that it \,·as a\varded by competiti,·e means.
