460 IAC 14.1-30-5 Administrative review

Sec. 5. (a) Except as provided in subsections (b) and (d), a person dissatisfied with the outcome of an impartial due process hearing may request administrative review conducted under IC 4-21.5-3-28. (b) A person may request administrative review by submitting a written and signed request to the director of the division within twenty (20) days of the mailing of the impartial hearing officer's decision. The director of the division may not delegate their authority for making a final decision to any other office or employee. (c) A person may submit additional evidence concerning an issue under administrative review under instructions issued by the director of the division. (d) A person requesting administrative review will receive a written decision within thirty (30) days from the date of the request. (e) The decision of the director of the division is final and must be followed unless the decision is overturned by a court.
