UAs may use the following types of contracts when procuring Professional services: A. Percentage of Construction Cost: The UA pays the Professional an amount limited to a percentage of the approved and projected budget. B. Stipulated Sum 1. The UA sets the total fee amount in the Professional solicitation. 2. For use when the scope of work is clearly identified or broken down into costs per specific tasks and/or milestones if partial/progress payments are anticipated. 3. Initial term plus any renewals may not exceed five [5] years. 4. The UA may include stipulated amounts for additional related work to be performed on an hourly basis. C. Hourly 1. The UA sets the pay rate and identifies that rate in the solicitation; or 2. The UA negotiates a rate with the most qualified Professional selected in competitive procurement. If a fair and reasonable rate cannot be negotiated with the Professional, the UA may negotiate with the next most qualified. 3. Initial term plus any renewals may not exceed five [5] years. D. Term 1. The UA may appoint a single Professional to all projects the UA might undertake during a specific term. 2. Pool appointments: The UA may also appoint a pool of several Professionals to all projects the UA might undertake during a specific term, and assign each project as needed. 3. Initial term plus any renewals may not exceed five [5] years. 4. The UA may pay the Professional on a stipulated sum, percentage or hourly basis.
