Substantial Progress

Substantial Progress.
In determining whether substantial progress has occurred toward implementation
of an approved project during a valid Certificate of Need period, the Department
may consider the totality of circumstances, including but not limited to:
1. Total project expenditures incurred;
2. Construction or renovation progress;
3. Financing commitments obtained;
4. Equipment acquisition or orders placed;
5. Contracts executed with contractors, vendors, or staff;
6. Site development activities; and
7. Other implementation efforts demonstrating active and material pursuit of
project completion.

No single factor shall be determinative. Substantial progress shall be evaluated
based upon the nature and scope of the approved project and the stage of
implementation at the time of review.
