[LOGO] COMMONWEALTH OF PUERTO RICO OFFICE OF THE COMMISSIONER OF INSURANCE December 28, 1995 Ruling No. AM-I-12-396-95 # TO THE INSURERS SYNDICATE AND TO ALL PROPERTY AND CASUALTY INSURERS AUTHORIZED TO TRANSACT PHYSICIANS AND SURGEONS PROFESSIONAL LIABILITY INSURANCE IN PUERTO RICO Subject: Certification required for the issuance of Physicians and Surgeons Professional Liability Insurance Policies Dear Sirs: Pursuant to the provisions of Act No. 11 of June 23, 1976, as amended, and Act No. 22 of April 22, 1931, as amended, the Board of Medical Examiners, hereinafter referred to as "the Board", has to establish every three years a register of the licenses issued by the Board. The Board has already established the register for the period of July 1, 1995, to June 30, 1998. In accordance with Section No. 17 of Act No. 22, the Board has the power to suspend the license of every physician or osteologist who does not submit to the Board the information required to establish the register. Regarding this matter, the Board has requested the assistance of this Office in order to implement a procedure by which insurers do not issue a professional liability policy to those physicians or osteologists whose licenses have been suspended by the Board. In view of the above, and taking into consideration that said professionals are required by law to be registered and licensed in order to practice their profession in the Commonwealth of Puerto Rico, we are hereby requesting from all insurers authorized to transact Physicians and Surgeons Professional Liability Insurance in Puerto Rico, that as a condition precedent to the issuance of a professional liability policy to a physician or surgeon, to require P.O. Box 8330 — Fernández Juncos Station — Santurce, Puerto Rico 00910 - 8330 -2- from the affected professional a certification from the Board indicating that the license of such professional is in force and that the same has never been suspended or revoked.
